It&#8217;s still pretty hush-hush at the moment, but there&#8217;s a new Twitter account that aims to increase awareness of activity from your &#8220;follow graph&#8221; &#8212; i.e., the notable things that are happening in the accounts that you follow. In the process, it also opens the door a tiny bit on the idea of direct messages as a marketing/content channel. More on that in a bit.</p>
<p>The <a href="https://twitter.com/MagicRecs">@MagicRecs</a> account is about as quiet as an account can be after Twitter CEO Dick Costolo <a href="https://twitter.com/dickc/status/346473546958123009">plugged it on Sunday night</a>, saying it&#8217;s &#8220;a product of some great work by the team here. Follow it!&#8221; (Despite that, @MagicRecs still has fewer than 2,000 followers as I type this.)</p>
<p>When we asked for more information, a Twitter spokesperson declined to comment on the account and only pointed us to <a href="https://blog.twitter.com/2012/innovate-through-experimentation">an old blog post</a> where Twitter talks about all the feature tests it conducts at any time. So, despite the odd choice of background imagery (it appears to be something by Friedrich Justin Bertuch), this is a real Twitter account.</p>
<h2>What Will @MagicRecs Offer Twitter Users?</h2>
<p>The account&#8217;s profile description promises &#8220;personalized real-time recommendations of users and content, delivered instantly as they happen, via direct message to you,&#8221; and says it won&#8217;t send more than three DMs per day.</p>
<p>I followed the account last night, and received this direct message earlier today:</p>

<p>It&#8217;s telling me that <a href="https://twitter.com/ignitordigital">@ignitordigital</a>, a new Twitter account representing an agency that two of my friends recently launched, was just followed by six of my followers. (I&#8217;ve blurred out the three @names mentioned in the DM since I didn&#8217;t ask for permission to include them in this image.)</p>
<p>It&#8217;s somewhat interesting for me to find out that a group of my followers have suddenly started following the same account, and this kind of DM from @MagicRecs may increase engagement if users join the crowd and follow new accounts as a result.</p>
<p>It&#8217;s not clear what other types of DMs the account will send out and what events will trigger them. With the account description also promising content recommendations, I&#8217;m expecting to get direct messages that tell me about links, photos and maybe even Vine videos that are popular in my follow graph.</p>
<p>Twitter engineer Tim Trueman tweeted on Friday about @MagicRecs, saying it&#8217;ll share direct messages about &#8220;accounts to follow and tweets not to miss.&#8221;</p>

<h2>Direct Messages For Content &amp; Marketing?</h2>
<p>Aside from the personalized recommendations, the other thing that @MagicRecs is notable for is its use of direct messages as a content and marketing channel.</p>
<p>I&#8217;m not a heavy user of Twitter direct messages (with any account that I follow), so this seems like a first to me &#8212; at least a first from Twitter itself using DMs in this way. (There must be other accounts that use direct messages to get content and marketing messages to followers, right?)</p>
<p>For me, Twitter direct messages have always been about private conversations with friends (that I try to move to email as quickly as possible) or customer service help from certain brands that I follow, so I feel like I&#8217;ve just opened a door that lets Twitter send me promotional messages where none were sent before. Over time, I&#8217;m bound to become more accustomed to getting impersonal messages via direct message &#8212; that might be good news for the brands I follow.</p>
<p>On a semi-related note, see <a href="https://twitter.com/MagicRecs/status/334404505036795904">this @MagicRecs public tweet</a> from a month ago, where the account announces that it&#8217;s &#8220;now enabled to get a DM from any follower.&#8221; This seems to be the first account/case where users can send DMs to an account even if the account isn&#8217;t following you. That goes against one of Twitter&#8217;s long-standing rules, that you can only send DMs to an account that&#8217;s following you. File that away for the future, and mark it now as one more reason that @MagicRecs is an interesting Twitter project &#8230; experiment or not.</p>

<p>The help page linked above offers a detailed video tutorial that shows a user taking a photo, getting product suggestions based on that photo and completing a transaction &#8212; all within the Glass interface. The Fancy app even confirms the purchase with a receipt sent to Glass.</p>
<p>It all happens &#8212; after authorizing the app &#8212; by setting up Fancy as a sharing contact in the user&#8217;s Google Glass account. Once a photo is taken, the user shares it with the &#8220;Fancy Color Search&#8221; contact. Fancy then returns a number of similar products back to the user&#8217;s Glass timeline. Those products can be shared or purchased. Here&#8217;s the demo video:</p>

<p>Google&#8217;s <a href="https://developers.google.com/glass/terms">current API terms</a> bar developers from making money via ads or by trying to charge for access to their apps. The language doesn&#8217;t appear to prevent developers from making money via e-commerce as Fancy is doing, but Google can always rewrite those terms whenever it wants &#8212; something that Fancy COO Michael Silverman is well aware of.</p>
<p>&#8220;Google Glass is a terrific innovation and Google is entitled to do whatever they want with their api and their rules,&#8221; Silverman said via email. &#8220;We are an e-commerce company. Ours is a shopping app. Developing for Google Glass was a breeze and a lot of fun.&#8221;</p>
<p>The Fancy help page says the app is still pending approval, but it&#8217;s actually ready now. Glass owners can visit <a href="http://glass.fancy.com">glass.fancy.com</a> to authorize the app and then activate it via the MyGlass home page.</p>

<p>The company <a href="http://blog.affiliatewindow.com/?p=44252">shared its May stats</a> this week, which show the increasing impact of mobile in the affiliate space: more traffic and more sales are coming from mobile devices than ever before.</p>
<p>Affiliate Windows says it&#8217;s recorded more mobile sales so far in 2013 than it did in the first 11 months of 2012. In May, there was a record of 572 sales per hour via mobile devices.</p>
<p>Across its network, 18.16 percent of all sales in May were mobile. That&#8217;s up from 16.48 percent in April, and more than double the 7.85 percent figure from May 2012.</p>

<p>Affiliate Window says the iPad is the number one device for sales, with about 57 percent of the total. The iPhone is second at 23 percent. Android devices account for 15.2 percent of sales that the company tracks.</p>
<p>Mobile traffic also set a record in May with 22.31 percent of overall network traffic &#8212; up from 10.95 percent in May 2012.</p>

<p>The iPad is also the top device where mobile traffic is concerned, but not by the margins mentioned above for sales. For traffic, the iPad accounts for about 39 percent compared to about 34 percent for the iPhone. In other words, there&#8217;s a group of consumers that may visit sites on the iPhone, but prefer to buy via the iPad.</p>
<p>Android devices accounted for about 21 percent of Affiliate Window network traffic in May.</p>

<p>The Oxford English Dictionary (OED) has <a href="http://public.oed.com/the-oed-today/recent-updates-to-the-oed/june-2013-update/a-heads-up-for-the-june-2013-oed-release/">just announced</a> its June 2013 update, and it includes several marketing/tech words that folks like us have been using for years. <p>John Simpson, Chief Editor of the OED, points out that the dictionary is breaking its own rule by adding &#8220;tweet&#8221; to the dictionary:</p>
<blockquote><em>The noun and verb tweet (in the social-networking sense) has just been added to the OED. This breaks at least one OED rule, namely that a new word needs to be current for ten years before consideration for inclusion. But it seems to be catching on.</em></blockquote>
<p>The folks at <a href="http://www.geekwire.com/2013/oxford-english-dictionary-adds-ereader-tweet-big-data/">Geekwire</a> point out that &#8220;retweet&#8221; was already added to the OED back in 2011 &#8212; proving what my mom and countless Language Arts teachers said a million times when I was a kid: The English language is strange.</p>

<p>Twitter and Vizify have <a href="https://blog.twitter.com/followme-create-an-instant-twitter-highlight-reel">partnered on a #FollowMe video creation tool</a> that collects a user&#8217;s Twitter profile activity and turns it into a video that runs about 30 seconds or so.</p>
<p>The video profiles include your most popular tweets, photos and Vine videos, along with info on what topics you tweet about most often, when you tweet most, and what other users you interact with the most.</p>
<p>The end result &#8212; or at least the goal, perhaps &#8212; is to make a short video that serves as a snapshot of the Twitter user and, assuming it&#8217;s interesting, can help them gain new followers. You can be the judge of whether that succeeds for my Twitter account:</p>

<p>The tool only needs a minute or so to create the video, and once it&#8217;s finished, there are several sharing options including Twitter, Facebook, Google+ and others &#8212; but not a direct embed option. (That&#8217;s why I had to tweet my video first and then embed the tweet above.)</p>
<p>If Vizify inserts a photo or other piece of information that you don&#8217;t want included, there&#8217;s also a great editing tool where you can either delete items completely, or edit what&#8217;s included &#8212; i.e., if you want to feature a different tweet as your &#8220;top tweet,&#8221; you can.</p>
<p>It&#8217;s free and something that brands can likely use to quickly show how they act and interact on Twitter and grow their followings.</p>

				<content:encoded><![CDATA[<p><img class="alignright spaceRight size-full wp-image-4856" alt="google-legal-law" src="http://marketingland.com/wp-content/ml-loads/2012/01/google-legal-law.jpg" width="200" height="200" />Google, Facebook and Microsoft have all asked the US government for permission to include data requests made under the Foreign Intelligence Surveillance Act (FISA), requests that are currently so secret that they&#8217;re not even allowed to acknowledge if they&#8217;ve received any.</p>
<p>During the whirlwind of news about the <a href="http://marketingland.com/library/legal/legal-prism">PRISM/NSA scandal</a>, news has circulated that all three companies are providing large amounts of data to the US National Security Agency (NSA) because of FISA.</p>
<h2>Google Asks To Talk About FISA</h2>
<p>In today&#8217;s <a href="http://googleblog.blogspot.com/2013/06/asking-us-government-to-allow-google-to.html">letter</a> to the US Attorney General&#8217;s office and FBI, Google&#8217;s top legal officer, David Drummond, fights back by pointing out that the government doesn&#8217;t allow Google to include them &#8212; and that if it could as part of its <a href="http://www.google.com/transparencyreport/">Google Transparency Report</a>, it would show there is no widespread sharing:</p>
<blockquote>Assertions in the press that our compliance with these requests gives the U.S. government unfettered access to our users’ data are simply untrue. However, <strong>government nondisclosure obligations regarding the number of FISA national security requests that Google receives</strong>, as well as the number of accounts covered by those requests, fuel that speculation.</p>
<p>We therefore ask you to help make it possible for Google to publish in our Transparency Report aggregate numbers of national security requests, including FISA disclosures—in terms of both the number we receive and their scope. Google’s numbers would clearly show that our compliance with these requests falls far short of the claims being made. Google has nothing to hide.</blockquote>
<p>I&#8217;ve added the bold part, notable because it actually acknowledges that Google does indeed get FISA requests. This really wasn&#8217;t in doubt, but Google&#8217;s standard statement until now was designed to not even admit it might have received any, to avoid violating the law.</p>
<p>This is what it said last week when asked I asked about FISA requests, a standard statement it had been giving anyone who asked:</p>
<blockquote>Due to US legal constraints we don’t discuss any legal requests issued under the national security laws, including provisions in the Foreign Intelligence Surveillance Act (FISA). The exception: We were able to <a href="http://googlepublicpolicy.blogspot.com/2013/03/transparency-report-shedding-more-light.html">add</a> general data about the number of National Security Letters we receive to our Transparency Report in March after discussions with U.S. government officials.</blockquote>
<p>That was part of a story where I explained the difference between Google, and the other companies, responding to limited one-off requests versus sharing data wholescale, as the PRISM system has been reported as allowing. The stories below have more about this:</p>

<p>Google has also <a href="http://www.wired.com/threatlevel/2013/06/google-uses-secure-ftp-to-feds/?cid=co8762884">explained to Wired</a> that that it uses a secure FTP system to deliver data when it receives legal requests, which is much different than providing an ongoing, on-demand streams without any review.</p>
<h2>Facebook &amp; Microsoft Follow With Similar Requests</h2>
<p>Facebook issued a similar <a href="http://newsroom.fb.com/Fact-Check">statement</a> today, after Google&#8217;s appeared:</p>
<blockquote>As Mark said last week, we strongly encourage all governments to be much more transparent about all programs aimed at keeping the public safe.</p>
<p>In the past, we have questioned the value of releasing a transparency report that, because of exactly these types of government restrictions on disclosure, is necessarily incomplete and therefore potentially misleading to users. We would welcome the opportunity to provide a transparency report that allows us to share with those who use Facebook around the world a complete picture of the government requests we receive, and how we respond.</p>
<p>We urge the United States government to help make that possible by allowing companies to include information about the size and scope of national security requests we receive, and look forward to publishing a report that includes that information.</blockquote>
<p>Microsoft also issued a similar statement after Google&#8217;s, <a href="http://www.reuters.com/article/2013/06/11/us-usa-security-microsoft-idUSBRE95A15N20130611">as reported by Reuters</a>:</p>
<blockquote>Permitting greater transparency on the aggregate volume and scope of national security requests, including FISA (Foreign Intelligence Surveillance Act) orders, would help the community understand and debate these important issues&#8230;.</p>
<p>Our recent report went as far as we legally could and the government should take action to allow companies to provide additional transparency.</blockquote>
<p>Unlike Google, neither of the other companies acknowledges receiving FISA requests (though it&#8217;s pretty certain they have). Facebook stays safe by not mentioning FISA at all; Microsoft names it but never says that it has actually received FISA requests.</p>

<p>I was taking Google Glass to its first rock concert, and I was going to shoot some photos and videos with it. I knew the photos would be fine, but I expected the videos to be a disaster. Actually, I was <em>worried about the audio</em> more than anything.</p>
<p>Here&#8217;s why: About a week before the concert, I <a href="http://www.youtube.com/watch?v=vt9i-i545lM">shot my first Glass video</a> on a bike ride near my house. If you watch that video, it sounds like I&#8217;m in the middle of a major catastrophic weather event. It was windy, but not <em>that bad</em>.</p>
<p>So, at the concert, I assumed the loud music would overwhelm Glass&#8217; tiny microphone and leave me with something that sounded like a chainsaw trying to cut through iron.</p>
<p>I was wrong.</p>
<p>Glass blew me away. I shot two videos at a concert by <a href="http://theboxerrebellion.com/">The Boxer Rebellion</a> last weekend in Portland. You can check out their song <a href="http://theboxerrebellion.com/">&#8220;Spitting Fire&#8221;</a> on YouTube if you want, and I&#8217;ll embed &#8220;Diamonds&#8221; here to save you the click if you just want to check out some audio:</p>

<p>There&#8217;s a tiny bit of scratchiness here and there, but that audio quality is every bit as good &#8212; if not better &#8212; than videos that I <a href="http://www.youtube.com/watch?v=35VAvTAFGzA">shot on the last U2 tour</a> with a regular Canon camera.</p>
<p>And I&#8217;d say that the experience of shooting at The Boxer Rebellion show was better with Glass for me and those around me. My arms didn&#8217;t get tired from holding a camera aloft for four-plus minutes, nor did I block anyone&#8217;s view in the process.</p>
<p>But, two downsides: One, if you&#8217;re shooting video with Glass, and you want the final product to be watchable, you have to keep your head pretty steady &#8212; dancing or grooving to a favorite song isn&#8217;t recommended. (Watch that &#8220;Spitting Fire&#8221; video if you want an example.) Two, the battery life on this version of Glass is pretty dreadful when video is involved. Those two songs I shot totaled about seven minutes and they were played back-to-back during the gig. The battery drained by 20 percent from start to finish.</p>
<p>Still, I consider my first Glass concert a success &#8212; especially after the disastrous audio on the bike ride. Now if only U2 would tour soon, I&#8217;d be able to test it again in a bigger venue with thousands more people singing along and making noise.</p>
